The China-EU School of Law FDI Moot teams have returned triumphantly from the China National rounds of the Foreign Direct Investment Moot competition, which took place in Shenzhen, from October 16 - 18. CESL had two teams participating, both of which advanced to the quarter-finals.
As fate would have it, during the quarterfinals CESL’s Team A was matched against Team B, which made it impossible for both CESL teams to move forward in this knock-out stage of the Competition. In a very closely argued round, it was Team B that prevailed, so that Team A finished the Moot in fifth place. Team B then advanced all the way to the Grand Finals and completed the Competition in second place overall.
Quarter finals - CESL v. CESL:
The FDI Moot provides student teams the opportunity to improve their analytical and oral skills in English, in this case in the area of international investment law. Foreign direct investment treaties apply to foreign entities that invest in the host state under the conditions at the time of the investment. Problems arise when there are changes to the law later that the investor claims harms its investment. In this case, the investment was a state-of-the-art coal power plant. Following a Directive from a consortium of states, the host state changed its laws to phase out coal powered plants. Therein lay the problem for this year’s FDI moot.
For Team A, the students participating as oralists were LIU Lusheng, JIANG Jiaying, SHI Jie, and YE Yabing. The faculty coach was Professor Monika PRUSINOWSKA. The second coach was TAO Zhilin, a CESL alumna and former mootie, who is currently working in Shenzhen.

For Team B, the students participating as oralists were JIA Shuxian, LI Xiaocong, HOU Yixuan, and OUYANG Yueying. The faculty coach was Professor Monty SILLEY. The second coach was YI Chen, another CESL alumna and former mootie, now working in Beijing. Professor Susan WINTERMUTH also provided valuable guidance to the team.

All the advocates demonstrated their excellent ability of making superior legal arguments in a tribunal setting and represented CESL admirably in this Moot.
